Ex- FBI Worker Claims Improper Dismissal Due to LGBTQ+ Banner Presence

An experienced FBI analyst has initiated legal action stating he was dismissed on account of displaying an LGBTQ+ banner in his workstation.

According to the plaintiff, that worked with the bureau since 2009, his termination in the past months is being described as “unconstitutional and politically motivated”.

Judicial Action Claims First Amendment Violations

The legal filing argues that the bureau violated Maltinsky’s First Amendment rights and took punitive steps in his case because of engaging in constitutionally covered speech.

The former specialist is seeking a legal ruling to restore his employment with the FBI.

Details from the Complaint

The 18-page filing, lodged in a Washington court in the nation’s capital, states that the employee was terminated from the FBI academy recently for earlier showing the Pride symbol at his workstation.

According to the filing, the LGBTQ+ banner was given to the plaintiff to honor his work to advance the agency’s equality efforts.

Since childhood, my only desire is serve my country and ensure public safety alongside the talented and committed personnel at the agency,” said Maltinsky.

He continued, “I displayed that banner – that previously was displayed at the Los Angeles office – not for political reasons, but as a representation of diversity, togetherness and fair treatment.

These principles that previously strengthened a robust FBI. Now it is a place where people like me face discrimination. I think I was terminated not on account of who I am, but what I am: a proud gay man,” he affirmed.

Abrupt Termination Prior to Graduation

Recently, the plaintiff was enrolled in the FBI special agent training academy in Virginia, up until what he called “sudden termination just three weeks before completion”.

The filing further alleges that later after the 2017 inauguration, another employee raised an issue to the overseeing official about the exhibition of the LGBTQ+ symbol.

As a precaution, Maltinsky requested that the Chief Division Counsel at the L.A. office review whether the presence of the LGBTQ+ banner was acceptable,” the document said.

The document continued, The legal officer told the plaintiff that the display of the banner complied with any bureau guidelines.”

Notification of Termination

However, on 1 October, the employee was informed of his dismissal.

In a document referenced in the lawsuit, FBI director the director stated, “I have determined that you exercised bad decision-making by exhibiting of a partisan emblem in your office in your prior role in Los Angeles.

Under Article II of the United States Constitution, and statutes of the United States, your job with the FBI is hereby terminated.”

Legal Comment

In a release issued this week, his legal representative the attorney stated, The current leadership’s illegal termination is a component of a larger campaign to purge public offices of employees that possess alternative perspectives, or represent minority populations, or individuals that oppose bias.

This battle goes beyond his situation, but about securing the liberties and protections of every government worker.”

Department Reaction

The agency refused to respond about the legal action.

Related Legal Cases

The case follows a separate case lodged recently by previous high-level bureau employees who said they’d been wrongfully terminated.

They stated that the official stated he had been ordered by the president’s office to dismiss any official participating in a probe into Trump.

At the same time, the agency dismissed an experienced official earlier this month following the director was said to be angered over news that the agency head had taken an official aircraft to be present at a match during which his partner rendered the anthem.

Steven Palmer, an FBI employee for many years, was removed from his role in the bureau’s emergency unit, responsible for major security threats and the agency’s jet fleet.
